Diversion

On March 9, 1998, the U.S. Supreme Court ruled in favor of haircare distributors and consumers: In a unanimous ruling, the US Supreme Court, 118 S.Ct.1125 (1998), found that once a lawful sale of a copyrighted item has occurred, the Copyright Act's prohibition against unauthorized distribution is inapplicable to a domestic or foreign distributor who decides to resell the item in venues other than those intended by the manufacturer of haircare or cosmetic goods. In the court's opinion: "Once the copyright owner places a copyrighted item in the stream of commerce by selling it, he has exhausted his statutory right to control its distribution."

We sell our retail products through a salon entity and we are licensed cosmetologists. We do not believe in diversion and will not sell wholesale, bulk, or in any way that we feel may put our products into the consumer mainstream circuit such as drug stores. Our products are to be used for the consumer only and not resold! We want you to order your products on the professional advice of your licensed cosmetologist and if you do not have your own, then we will be happy to act as your personal shopper. Our Guarantee

We guarantee all of our products and will be happy to take back merchandise within 30 days of receipt. Please be sure of what you are ordering as we cannot return used products to our distributor unless they are defective. Your order total will be refunded if we have erred in our shipment. If the wrong product was ordered, the wrong address supplied, or there has been a change of mind regarding the product - then your shipping charge will not be refunded.

We use USPS and FEDEX for USA shipments. Shipping & handling also includes: boxes, tape, peanuts, bubbles, packing employees, etc - this is why there is a handling charge!

Larger orders are usually shipped FEDEX with signature required for our protection.

Stolen Merchandise

Spiral Haircase can not be held responsible for lost or stolen merchandise once it has been delivered by postal carrier to your address. It is the purchaser's responsibility to ensure that products purchased are sent to a secure location (such as a PO Box, a place of residence where someone is home to accept the package, or a place of employment where someone is there to accept the package.)

Backorders

We keep a large inventory at Spiral Haircase but occasionally our suppliers can't always get our shipments in time - so we do run into a back order situation. If this happens, and we can not fill your order within a 10 day time frame, we will credit your account for unavailable items and ship the remaining products.

Every one hundredth USA order is FREE so contact us if your order ID# ends in 01. You will be credited back immediately for your order!

How long?

Most orders will process and ship within 1-6 working days of receipt. Processing time does not include shipping time. We strive to have orders to you within 7 business day, but please allow up to 14 business days for your shipment in case something is backordered.
